Housebuilder launches Thornhills consultation despite Judicial Review in High Court

Following Calderdale Council’s adoption of their Local Plan on 22 March, the Clifton Neighbourhood Forum, with support from community groups across Calderdale, applied to the High Court seeking permission for a Judicial Review.

On Friday, 25 August 2023, Deputy High Court Judge Karen Ridge granted permission for a judicial review of Calderdale Council’s Local Plan. Permission has been granted despite arguments from Calderdale Metropolitan Borough Council (First Defendant) and the Secretary of State for Levelling Up, Housing and Communities (Second Defendant).

We look forward to the High Court hearing when we present our case concerning the flawed Calderdale Strategic Transport Model and the consequences of a Local Plan based on outdated and inaccurate evidence.

The current position

Until the hearing (and such time as the adopted Local Plan is found to be unsound), the plan adopted on 22 March 2023 is the current plan. This means that legally, there is nothing to prevent Calderdale Council, land promoters, developers or builders from holding consultations or submitting planning applications.

Thornhills Garden Suburb consultation

In the last few days, some local residents received an invitation (dated 13th November) to attend a public consultation on Wednesday 22nd November at the Mulberry Suite, Brighouse Six Form College between 5pm and 8pm. The invitation was not sent to the Clifton Village Community Association or the Clifton Neighbourhood Forum.
